Welcome to kokomall.com.au (the ‘Website’). The Website provides you with an opportunity to browse and purchase various products that have been listed for sale through the Website (the ‘Products’). The Website provides this service by way of granting you access to the content on the Website (‘the Purchase Services’).
The Website is operated by kokomall.com.au. Access to and use of the Website, or any of its associated Products or Purchase Services, is provided by KOKO Mall. Please read these terms and conditions (the ‘Terms’) carefully. These Terms govern your use of the Website and application, including online ordering.
Subject to law, KOKO Mall reserves the right to review and change any of the Terms by updating this page at its sole discretion. When KOKO Mall updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records. KOKO Mall recommends you carefully read, each time you visit the Website, the Terms as they may affect your rights.
These Terms apply to all users of the Website. The Website may include content, information or links to third-party websites. By accepting these Terms, you agree to hold harmless and relieve KOKO Mall from any liability whatsoever arising from your use of information from a third party or your use of any third-party websites. KOKO Mall recommends before you disclose any personal information to a third party that you first read and accept the third party’s privacy policy and terms and conditions of us of their website.
By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of the Purchase Services, immediately.
Acceptance of the Terms
You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by KOKO Mall in the user interface.
Registration to use the Purchase Services
In order to access the Purchase Services, you must first register as a user of the Website. As part of the registration process, or as part of your continued use of the Purchase Services, you may be required to provide personal information about yourself (such as identification or contact details), including:
- an email address
- preferred name
- a mailing address
- a telephone number
- a password
You warrant that your information you give to KOKO Mall in the course of completing the registration process will always be accurate, correct and up to date.
Once you have completed the registration process, you will be registered member of the Website (‘Member’) and agree to be bound by the Terms. As a Member, you will be granted immediate access to the Purchase Services.
Access to the website
KOKO Mall hereby provides its permission for you to access its Website in accordance with these Terms, provided that:
- your use of the Website is solely for your individual, personal, commercial and non-commercial use;
- you will not copy, distribute or publish any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and
- you will otherwise comply with the Terms.
You agree not to use of launch, or cause to be used or launched, any automated system or program in connection with the Website, online or SMS ordering, including without limitation, publishing or distributing vouchers or codes, “robots”, “spiders”, “offline readers” and the like. Notwithstanding the foregoing, KOKO Mall grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. KOKO Mall reserves the right to revoke these exceptions either generally or in specific cases.
You agree not to collect or harvest any personally identifiable information from the Website or use the communication systems provided by the Website for any commercial solicitation purposes. You agree not to solicit for any reason whatsoever any users of the Website with respect to their submissions to the Website.
Online Ordering
If the Website, application or any electronic device is used, you are responsible for maintaining the confidentiality of your personal details, password and payment details. You acknowledge that you may remain logged in to the Website or application when you access the Website or an application. We therefore highly recommend that you log out of all services when you have finished using the Website or application.
You agree to accept full responsibility for all your activities on our Website and applications. KOKO Mall reserves the right to refuse service, terminate your access to the Website or application, remove or cancel your orders in its sole discretion and without prior notice to you. We may ask you to provide additional details or require you to confirm your details to enable us to process your order placed through the Website.
Restricted Products
You acknowledge that it is against the law to sell or supply alcohol products to, or obtain alcohol products on behalf of, a person under the age of 18 years and warrant that you are not obtaining alcohol on behalf of a person under the age of 18 years. If you are under 18 years of age, you cannot use the Website to place an order for alcohol. It is a condition of purchase that you verify that you are 18 years of age or over. If you do not confirm that you are 18 years or over, your order will not be processed.
You agree that we may rely on any person who is at the address you gave for delivery, and who takes receipt of your ordered products, as being authorised for that purpose.
We will not deliver your order if we consider any delivery circumstances may be unsuitable for any reason, including because any likely recipient of the ordered products appears to our delivery personnel to be under the influence of alcohol or drugs, under the age of 18 years or acting for on behalf of a person who we consider may be unsuitable for any reason. We may not deliver your order if any of our requests for verification are not met.
Delivery & Shipping
In these Terms, delivery of products (‘Delivery’) includes collection of them under our pick-up service.
Address for Delivery:
You agree that address to which we may deliver is the address you gave for delivery as part of your order or any other address we may subsequently agree to accept as the delivery address.
Delivery returns/non-collection:
If having commenced delivery of your order, we return any ordered products to our store or our storage site, while we will refund the amount paid by you for those products (in the absence of an arrangement with you for re-delivery), you agree that we may deduct a fee of up to $25.00 from this refund amount on account of the costs incurred by us in returning the relevant products to our store or storage site. You agree that we may make such deduction where we were unable to deliver due to circumstances beyond our reasonable control (including because of the wrong address appearing to use to have been given or no one was attended at the Delivery address. In the instance of failure of delivery, you can contact us by using the “Contact Us” facility on the Website or by telephoning our Customer Service Team on 02-8091-7333 or email manager@kokomall.com.au to arrange ‘same day in-store pickup’ or ask for re-delivery at extra charge.
If you require ‘in-store pickup’ at another day, you can collect products from our store or storage site within 7 days. However, you agree that we will not be able to refund any perishable Products that were ordered.
In the instance that we arrange for re-delivery at a different time, we may charge you an additional delivery fee of $25.00. You agree that we will not be able to refund any perishable Products that were ordered.
If you are present at the Delivery address, we will deliver the Products to the front door at the Delivery address. You agree that we will not be responsible for any loss or damage caused to your property or suffered by you in connection with our delivery of the Products to the Delivery address.
You may contact us about any non-delivery or pick-up collection matters by using the “Contact Us” facility on the Website or by telephoning our Customer Service Team on 02-8091-7333 or email manager@kokomall.com.au
Cancellations by KOKO Mall:
We may cancel your order before delivery in whole or in part. We may do this even if we have received payment from you or sent you a tax invoice. In the case of pick-up orders, we may make such cancellation before collection of the products. Any such cancellation shall be giving you such reasonable cancellation notice as we are able to provide via any of the contact details we have for you. The circumstances in which we may cancel your order are if; (1) any of the ordered products are not available, (2) there was any error in the description of any ordered products as advertised, (3) your order is in breach of any other terms and conditions, or (4) these Terms provide that we may not deliver your ordered products.
Cancellations by you:
You agree that you cannot change or cancel an order after it has been placed. If you wish to change of cancel your order, please contact our Customer Service Team as soon as possible on 02-8091-7333 or email manager@kokomall.com.au. Please review our trading hours before calling as the hours may vary depending on the day of the week.
You may cancel your order with no charges if (1) you cancel an order that has been accepted by us and (2) you cancel an order by 02:30pm on the day before the delivery.
In all other circumstances, we may charge you a cancellation fee of the lesser of $20 or the costs to KOKO Mall arising from the cancellation plus the charges of 50% of the original price for any perishable Products that were ordered.
If we agree to you changing or cancelling your order after it has been placed, we may do so subject to your providing proof of purchase, to the ordered products being in their original condition and packaging and to you agree to pay an amount we request on account of our reasonable costs of processing the change or cancellation.
Delivery records
We may record all details of an incidental to deliveries. We will only use and disclose such records for reasonable purposes, which may include proof of delivery, administration, complying with record keeping requirements.
Missing items in delivery
If there are items missing from delivery, please contact our Customer Service Team on 02-8091-7333 or email manager@kokomall.com.au for us to take steps to verify and confirm any such missing items. Once it is confirmed that the item was not delivered to you, we will provide you with a credit to your account within 3-5 business days for the Products that were not delivered to you.
Fees and Charges
We will charge you, and you agree to pay, the following fees and charges in relation to an order that we accept:
- the purchase price of each Product that is ordered;
- the delivery fee provided to you at the time you selected the relevant delivery window when placing your order or the delivery fee shown on the Website;
- the cancellation fee for an order that is cancelled as set out in these Terms; and
- any other fees and charges set out in these Terms.
All fees and charges identified in these Terms and all prices for the Products include GST where applicable. The purchase price of each Product is displayed on the product list on the Website at the time you place an order. The purchase price of a Product on the Website may differ from the prices in any of other places for the same Product.
Returns
If you wish to return Product in accordance with our Returns Policy, please contact our Customer Service Team on 02-8091-7333 or email manager@kokomall.com.au to make arrangements to return the Product to us.
Refunds
If you did not like your products, then please let us know as soon as possible by using the “Contact Us” facility on the Website or by telephoning our Customer Service Team on 02-8091-7333 or email manager@kokomall.com.au We will replace or refund your order as soon as possible. Please be advised that it may take up to 10 working days for the refund to be processed.
Liability
Our goods and services come with guarantee that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled; (1) to cancel your service contract with us and (2) to a refund for the unused portion or to compensation for its reduced value. You are also entitled to choose a replacement for major failures with goods.
